Morgan was a juvenile in 1979 when he was convicted of second-degree murder and sentenced to life in prison with the possibility of parole after 25 years. In 2016, Morgan filed a post-conviction motion in trial court arguing that his life sentence was illegal, and he was entitled to resentencing pursuant to changes in juvenile sentencing. The trial court denied the motion based on subsequent changes to juvenile sentencing case law. On appeal, the Second District Court of Appeal agreed with the trial court. Morgan has asked this Court for review, arguing that the Second DCA decision conflicts with other appellate court decisions.
