2/11/21 Florida Supreme Court Oral Arguments: Michael D. Spear v. State of Florida SC20-676
At a resentencing hearing for multiple felony counts, Spear was erroneously awarded too much credit for jail and prison time served. The trial court, on its own motion, amended each judgment and sentence to correct the errors. Spear appealed to the Fifth District Court of Appeal, challenging the trial court’s authority to correct time served credit after a judgment and sentence become final. The Fifth District Court of Appeal agreed that the trial court had the authority to correct sentencing documents but certified a question of great public importance to this Court and certified conflict with other appellate court decisions. Spear asked this Court for review.
