9/8/20 Florida Supreme Court Oral Arguments: Gerhard Hojan v. State of Florida SC18-2149
Hojan was convicted of, among other crimes, the first-degree murders of Christina De La Rosa and Willy Absolu, who were fatally shot during a restaurant robbery in 2002. The jury voted 9-3 to recommend death sentences for each murder, and the trial court sentenced him to death. This Court upheld the convictions and sentences on direct appeal. On postconviction, this Court vacated Hojan’s death sentences and remanded for a new penalty phase pursuant to Hurst v. State. At resentencing, the jury voted 12-0 to recommend death sentences for each murder, and the trial court sentenced Hojan to death. This appeal followed.
