As personal representative of her mother’s estate, Pauline Walters petitioned the probate court to order that the decedent’s sole asset and interest in a cooperative apartment on Miami Beach be designated homestead property. The Agency for Health Care Administration (AHCA) filed a claim against the estate and objected to Walters’ petition for homestead protection because the homestead designation would prevent the AHCA from collecting amounts owed by the decedent. The trial court denied Walters’ petition, and she appealed. The Third District Court of Appeal upheld the trial court’s ruling and certified a question of great public importance to this Court.
