4/7/21 Florida Supreme Court Oral Arguments: The City of West Palm Beach, Inc. v. Peter M. Haver, et. al SC20-1284

The Havers suspected that their neighbor was violating zoning ordinances and building codes, so they reported their neighbor to the City of West Palm Beach.  The City of WPB investigated and found no violation.  The Havers then sued the City of WPB, asking the trial court to compel the City to enforce the zoning and building codes against the neighbor. The trial court entered an order dismissing the lawsuit.  The Havers appealed to the Fourth District Court of Appeal, arguing that the City of WPB must enforce the codes under Florida law. The Fourth DCA agreed in part and reversed in part.  The City of WPB asks this Court for review, arguing that the Fourth DCA decision conflicts with other appellate court decisions.
