11/3/21 Florida Supreme Court Oral Arguments: Airbnb, Inc. v. John Doe, et. al. SC20-1167
A couple filed a lawsuit against the owner of a vacation rental and Airbnb. In response, Airbnb filed a motion to compel arbitration. The circuit court granted Airbnb’s motion, ordered arbitration, and the couple appealed. The Second District Court of Appeal reversed the circuit court’s order, concluding that there was not clear and unmistakable evidence that the parties agreed an arbitrator would determine whether a dispute is subject to the contract’s arbitration provision. Airbnb asks this Court for review, arguing that the Second DCA’s decision conflicts with other appellate court decisions.
