11/3/21 Florida Supreme Court Oral Arguments: Laurel M. Lee, Etc. v. County of Volusia, et. al. SC20-1356
Volusia County filed a lawsuit, naming the Florida Secretary of State as a defendant, that challenged the application of a 2018 constitutional amendment that governs the selection and functions of county constitutional officers. Volusia County argued that it was not subject to the amendment. The First District affirmed the trial court’s decision that Volusia County must comply with the amendment and the trial court’s ruling that the Secretary was a proper party in the litigation. The Secretary sought this Court’s review, arguing that the First District’s decision (1) expressly affects a class of constitutional and state officers and (2) expressly construes a provision of the state constitution. The Court granted review, and the Secretary argues before this Court that Volusia County lacked standing to sue.
