Boston was convicted of misdemeanor battery for attacking his work supervisor with a hammer. At trial, Boston argued that he acted in self-defense. During his Stand Your Ground immunity hearing, the trial court ruled that Boston was the aggressor, and the judge denied Boston’s motion for immunity. Boston appealed his conviction to the First District Court of Appeal, arguing that the trial court applied the wrong standard during his immunity hearing. During Boston’s appeal, Florida’s Stand Your Ground immunity law changed, and the First DCA decided that he was not entitled to a new immunity hearing. Boston asks this Court for review because the First DCA decision conflicts with another appellate court decision.
