Several insurance companies challenged the retroactive application of Florida law that requires companies to search a database to determine whether policyholders have died, to contact beneficiaries, and to turn over unclaimed insurance proceeds to the State of Florida five years after the policyholder’s death. They argued that retroactive application of the law violates Florida’s due process clause. The trial judge agreed with the insurance companies, and Jimmy Patronis appealed in his official capacity as Chief Financial Officer of the State of Florida. The First District Court of Appeal reversed the trial court’s ruling, and this review proceeding followed.
