12/8/21 Florida Supreme Court Oral Arguments: Ned William Wilson III v. State of Florida SC20-1870
Wilson was convicted of sexual battery upon a minor by a person in custodial authority and lewd and lascivious conduct. He was sentenced to 25 years in prison. Wilson appealed his sentence, arguing that the trial court erred when it denied his motion for a downward departure. The First District Court of Appeal dismissed the appeal for lack of jurisdiction, and this appeal followed. This Court accepted this case because the First DCA’s decision conflicts with other appellate court decisions.
