Duke Energy Florida, LLC (DEF) appeals a final order of the Public Service Commission (PSC) that barred DEF from recovering approximately $16 million in replacement power costs due to a forced outage at its power plant. DEF asks this Court for review, arguing the recommended order was not supported by competent, substantial evidence and the PSC applied the incorrect standard in considering DEF’s exceptions to the recommended order.
