Thach stood trial for multiple counts of sexual battery. During the trial and over Thach’s objections, the court granted the State of Florida’s motion to amend four sexual battery charges to lewd or lascivious molestation. A jury convicted Thach on these four counts and others, and he was sentenced to prison. Thach appealed to the First District Court of Appeal, arguing that the trial court erred in allowing the State to amend the charges mid-trial. The First DCA affirmed the trial court’s ruling, and this appeal followed. Thach argues that the First DCA ruling conflicts with other appellate court decisions.
